1 General, Contract Language

(1) Scope of Application of the General Terms and Conditions These General Terms and Conditions (GTC) apply to all services provided by Digital Language Testing UG (limited liability), in particular examinations, sample examinations, language courses, and optional additional services such as identity verification (e.g., PostIdent), which are concluded between Digital Language Testing UG and the customer (student or examination candidate). The currently valid examination regulations of Digital Language Testing UG (available at any time at www.deutschtest.digital/pruefungsordnung) are an integral and formal part of these General Terms and Conditions. By accepting these GTC, the customer fully acknowledges the provisions of the examination regulations as contractually binding. Deviating or conflicting terms and conditions of the customer will only be recognized if Digital Language Testing UG expressly confirms them in writing.

(2) Amendments to the Terms and Conditions. Amendments to these Terms and Conditions will be communicated to the customer in writing, by fax, or by email. Changes that are detrimental to the customer will only become effective if the customer expressly agrees to them. Changes of an editorial, clarifying, or advantageous nature will be deemed communicated and accepted unless the customer objects in writing within four weeks of receipt. The customer will be separately informed of their right to object and the consequences of remaining silent.

(3) Contract Language The language available for concluding the contract is exclusively German. Translations into other languages ​​are for informational purposes only. In case of discrepancies between language versions, the German version shall prevail.

2. Applicable law, mandatory consumer protection regulations

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), provided that (a) the customer has their habitual residence in Germany, or (b) the customer's habitual residence is in a state that is not a member of the European Union. For customers residing in the EU, German law remains applicable, without prejudice to any mandatory provisions of the state in which the customer has their habitual residence.

3. Subject matter of the contract, conclusion of the contract

(1) Non-binding presentation of products and services The presentation of our products and services on the website www.deutschtest.digital does not constitute a legally binding offer. It serves only to inform customers.

(2) Ordering process in the online shop In the online shop, the customer selects the desired products or services. By clicking the "Buy now" or "Book now" button, the customer goes directly to the checkout.

(3) Submitting a binding offer in the checkout area (3) By selecting the corresponding checkbox, the customer confirms that they have read and accepted the General Terms and Conditions , including the integrated examination regulations , the cancellation policy, the privacy policy, and any other applicable data protection information . By clicking on one of the payment processing buttons ("PayPal - Buy now", "Direct debit - Buy now", or "Credit/Debit card"), the customer submits a binding offer to purchase the selected products or services.

(4) Payment Processing The customer will then be redirected to the respective payment provider to complete the payment. In case of unexpected payment problems, the customer should first contact Digital Language Testing UG support before attempting to book again.

(5) Conclusion of the Contract The contract between the customer and Digital Language Testing UG is concluded upon dispatch of the automatic order confirmation by email. If no payment has been made by this time, it is mandatory to make payment thereafter.

(6) Self-booking and payment. The customer confirms that they are booking the products or services for themselves and will use them at their own risk. The customer agrees to use only their own payment methods, such as personal credit cards or PayPal accounts. The contract becomes effective upon completion of the booking. Payment is due immediately after booking and must be made without delay.

(7) Termination of the contract The relevant provisions of the German Civil Code (BGB) shall apply to the termination of the contract.

4 Correction note

During the ordering process, the customer can remove services at any time. After clicking "Continue," the customer enters their information and selects the shipping/payment method. The customer then reviews their information on the overview page. Input errors can be corrected via "Edit." If the customer cancels, they can simply close the browser window. After clicking "Place order," the customer's declaration becomes legally binding.

5. Storage of the contract text

The contractual terms and conditions, including the booked services, these Terms and Conditions, and the cancellation policy, will be sent to the customer via email. Digital Language Testing UG does not store the contractual terms and conditions.

6 Datenschutz

We handle customer personal data responsibly. Further information about data processing and customer rights can be found in our privacy policy.

7 Payment terms

(1) Payment methods: Payment is accepted exclusively via PayPal or Stripe. (2) Prices and taxes: All prices are final prices including statutory VAT. (3) Offsetting and retention rights: Offsetting is only permitted if the customer's counterclaims are undisputed or have been legally established. Retention rights may only be asserted arising from the same contractual relationship. (4) Payment processing: Our services will only be provided after full payment has been received.

8 Examination requirements – procedure, obligations and additional requirements

(a) Obligations of the examinee

1. Preparation: The customer must prepare according to the examination regulations at www.deutschtest.digital/pruefungsordnung . These examination regulations are a legally binding part of the contract. A checklist will also be provided by email.

2. Email communication: After booking, the customer regularly checks their email inbox, including the spam folder.

3. Technical requirements: Basic computer skills, a laptop/PC, webcam, headphones, keyboard with accented characters, mouse, and a stable internet connection (min. 600 kbps SD / 1,2 Mbps HD) are required. Tablets are not permitted. If proper conduct or supervision of the exam can no longer be guaranteed due to technical issues, the exam may be terminated after 15 minutes.

4. Participation: Punctual attendance in the Zoom meeting room is mandatory.

5. Proof of identity: Upload a photo of your ID (front/back) and a selfie in advance, and present the original ID document during the exam. Head coverings are prohibited during the exam.

6. Acceptance: It is the customer's responsibility to find out about the acceptance of the certificate by the respective target authority/institution.

(b) Examination procedure and cancellation In the event of examination cancellations due to technical problems or other circumstances attributable to the customer, there is no entitlement to a refund of the examination fee.

(c) Evaluation and publication of results. The evaluation is carried out according to standardized criteria. Failure to pass does not entitle the participant to a refund of the fee. The detailed results will be published digitally via the “Quality Connect Hub” in accordance with the conditions in section 8(f).

(d) Additional Identity Verification In cases of justified doubt regarding identity, the issuance of a certificate may be made contingent upon additional, voluntary identity verification (e.g., PostIdent). The customer bears the costs (€25,00 incl. VAT). Without successful identity verification, there is no entitlement to a certificate.

(e) Changes to appointments, cancellations, illness

1. In the event of unforeseen circumstances, Digital Language Testing UG may offer alternative dates or vouchers.

2. In case of illness (notification up to 2 hours before the start + doctor's certificate), the customer will receive a voucher less a 25% administration fee. The customer is entitled to prove that no expenses were incurred or that the actual expenses were significantly lower than the fee.

(f) Quality assurance and activation of the score report

1. To ensure quality standards in accordance with ISO 29992, Digital Language Testing UG uses a digital feedback system.

2. Viewing results: Access to the complete exam results and their explanation in the application requires the submission of an objective evaluation of the exam procedure (minimum length 50 characters, German language).

3. PDF Download: If, after reviewing the results, the customer agrees to conduct a more in-depth evaluation, the detailed results sheet (score report) will be made available for download as a PDF document as a reward for this additional contribution to quality assurance.

4. Digital Language Testing UG reserves the right not to recognize obviously inappropriate content as fulfillment of the obligation to cooperate.

9. Service provision, scope of services, third-party software

(1) Appointments are non-transferable. (2) No guarantee is given for achieving a specific exam result. (3) Use of the service requires the installation of freely available third-party software (e.g., Zoom) at the user's own risk. (4) Certificates: Official language certificates will only be sent digitally via email to those who pass the exam. Participants who fail the exam will not receive a certificate, but will have access to the results report as per section 8(f).

10 liability

(1) We are liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. (2) In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable damages typical for this type of contract. (3) Permanent availability of the online system is not guaranteed.

11 Final Provisions

(1) Amendments or additions should be made in writing. (2) The place of jurisdiction is Stadthagen, provided the customer is a merchant or has no general place of jurisdiction in Germany. (3) Online dispute resolution: https://ec.europa.eu/consumers/odr/ . (4) Severability clause: Should individual provisions of these Terms and Conditions be invalid, the remainder of the contract shall remain unaffected. The statutory provisions shall apply in place of the invalid provisions.
