§ 1 General, Contract Language
(1) Scope of application of the General Terms and Conditions
These General Terms and Conditions (GTC) apply to all service contracts concluded between the customer (student or exam candidate) and Digital Language Testing UG (limited liability), unless expressly agreed otherwise in writing. We do not accept any deviating or conflicting terms and conditions unless we have expressly agreed to them.
(2) Changes to the Terms and Conditions
Changes to these Terms and Conditions will be communicated to the customer in writing, by fax, or by email. Adverse changes will only become effective if the customer expressly consents. Editorial, clarifying, or advantageous changes are deemed to have been communicated and accepted unless the customer objects in writing within four weeks of receipt. The customer will be specifically informed of their right of objection and the consequences of non-compliance.
(3) Contract language
The language available for concluding the contract is exclusively German. Translations into other languages are for information purposes only. In the event of any discrepancies between language versions, the German version shall prevail.
§ 2 Applicable law, mandatory consumer protection provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless
(a) the customer has his habitual residence in Germany, or
(b) the customer’s habitual residence is in a country which is not a member of the European Union.
For customers residing in the EU, German law remains applicable, without prejudice to mandatory provisions of the customer's country of habitual residence.
§ 3 Subject matter of the contract, conclusion of the contract
(1) Non-binding presentation of products and services
The presentation of our products and services on the website www.deutschtest.digital does not constitute a legally binding offer. It is provided solely for the information of our customers.
(2) Ordering process in the online shop
In the online shop, the customer selects the desired products or services. By clicking the "Buy now" or "Book now" button, the customer goes directly to the checkout process.
(3) Submission of a binding offer in the checkout area
By selecting the corresponding checkbox, the customer confirms that they have read and accepted the General Terms and Conditions, the Cancellation Policy, the Privacy Policy, and any other data protection notices. By clicking one of the payment processing buttons ("PayPal - Buy Now," "Direct Debit - Buy Now," or "Credit/Debit Card"), the customer submits a binding offer to purchase the selected products or services.
(4) Execution of payment
The customer will then be redirected to the respective payment provider and can complete the payment there. In case of unexpected payment issues, the customer should first contact Digital Language Testing UG's support team before making another booking.
(5) Conclusion of the contract
The contract between the customer and Digital Language Testing UG is concluded upon the automatic order confirmation being sent via email. If payment has not been made by then, payment is mandatory.
(6) Self-responsible booking and payment
The customer confirms that they are booking the products or services for themselves and using them at their own risk. The customer agrees to use only their own means of payment, such as personal credit cards or PayPal accounts. The contract becomes effective upon completion of the booking. Payment is due immediately after booking and must be made without delay.
(7) Termination of the contract
The relevant provisions of the German Civil Code (BGB) apply to the termination of the contract.
§ 4 Correction notice
During the ordering process, the customer can change the desired quantity or remove services at any time. After clicking "Continue," the customer enters their data and shipping/payment method. The customer then reviews their details on the overview page. Input errors can be corrected by clicking "Edit." If they cancel the order, the customer can simply close the browser window. After clicking "Order with payment," the customer's declaration is binding.
§ 5 Storage of the contract text
The contractual terms and conditions, including the booked services, these Terms and Conditions, and the cancellation policy, will be sent to the customer via email. Digital Language Testing UG does not store the contractual terms and conditions.
§ 6 Data protection
We handle customer personal data responsibly. Further information about data processing and customer rights can be found in our Privacy Policy.
§ 7 Terms of Payment
(1) Payment methods
Payment is made exclusively via PayPal or Stripe.
(2) Prices and taxes
All prices are final prices including statutory VAT. Errors, printing errors, and typos excepted.
(3) Set-off and retention rights
Set-off is only permissible if the customer's counterclaims are undisputed or legally established. Rights of retention can only be asserted within the same contractual relationship.
(4) Payment processing
Our services will only be provided after full payment has been received. Payment is considered made once the amount has been credited to our bank or PayPal account.
(5) Examination aborted due to technical problems
If the exam is canceled due to technical problems or other circumstances for which the customer is responsible, there is no right to a refund of the exam fee. The customer is responsible for ensuring that the technology and internet connection meet the requirements.
(6) Assessment of examination results
The assessment is based on established, standardized criteria. Failure or dissatisfaction does not entitle the customer to a refund of the examination fee.
(7) Priority of refund policies
By using PayPal, the customer agrees that Digital Language Testing UG's refund policy takes precedence over PayPal's policies. Refund claims via PayPal can only be enforced by law.
§ 8 Duties of the test candidate
(1) Acceptance testing of certificates
The requirements for the acceptance of language certificates cannot be standardized across institutions, companies, organizations, and authorities, both domestically and internationally. It is the customer's responsibility to check with the relevant authority regarding the validity and acceptance of the certificate issued by Digital Language Testing UG for the intended purpose.
(2) Preparation for the exam
The customer must prepare for the exam content and organization in accordance with the examination regulations at www.deutschtest.digital/pruefungsordnung. A checklist will also be provided via email. If the customer does not receive this checklist, they must notify Digital Language Testing UG at least 48 hours before the exam begins.
(3) Email communication
After booking, the customer should regularly check his/her email inbox, including the SPAM folder, for messages from Digital Language Testing UG.
(4) Proof of identity and selfie upload
Before taking the exam, the customer must upload the front and back of a valid ID document (e.g., passport or German-issued ID card) as well as a recent selfie without headgear. This identical ID document must be shown to the examiner at the start of the exam. Fake certificates, driver's licenses, documents without a photo, or expired documents are not acceptable. Headgear is prohibited during the exam.
(5) Technical requirements
The candidate requires basic computer skills, a laptop/PC, webcam, headphones, a keyboard with umlauts, a mouse, and a stable internet connection. For 1:1 video calls, a minimum internet connection of 600 kbps (SD) or 1,2 Mbps (HD) is required. Tablets are not permitted. Non-functioning technology may result in the exam being aborted after 15 minutes.
(6) Participation in the examination date
Punctual attendance in the Zoom meeting room is mandatory. Failure to attend or late arrival will result in forfeiting the exam fee.
§ 9 Provision of services, scope of services, third-party software
(1) Lesson and examination dates are non-transferable and can only be attended by the customer in person.
(2) Our examination and teaching services are provided as part of leisure activities with fixed appointments.
(3) Digital Language Testing UG may employ freelancers and selects them carefully.
(4) No guarantee is given that a particular examination result will be achieved.
(5) The use of our services requires freely available software, which must be downloaded and installed by the customer themselves. There is no contractual relationship between Digital Language Testing UG and the software provider. Use is at the customer's own risk.
(6) Certificates will only be sent digitally in PDF format by email to the customer if the exam is passed.
§ 10 Changes of appointments, cancellation, illness
(1) In the event of unforeseeable events (e.g. technical malfunctions), Digital Language Testing UG has the right to offer the customer an alternative examination date or to issue a voucher code for rebooking an examination date.
(2) In case of illness, the customer must notify Digital Language Testing UG by email at least two hours before the exam begins. A medical certificate must be submitted on the same day. The customer will receive a voucher for the exam fee, less a 25% administration fee for rebooking.
§ 11 Liability
(1) Digital Language Testing UG is liable for intent and gross negligence. In the event of a negligent breach of essential contractual obligations, compliance with which the customer may regularly rely, Digital Language Testing UG is only liable for foreseeable, contract-typical damages. Liability is excluded for slightly negligent breaches of other obligations.
(2) Liability for culpable injury to life, body, or health remains unaffected. Liability under the Product Liability Act remains in effect.
(3) Internet communication cannot be guaranteed to be error-free at all times. Permanent availability of the online system is not guaranteed.
§ 12 Final provisions
(1) These Terms and Conditions are complete and conclusive. Any amendments or additions should be made in writing.
(2) If your place of residence or habitual abode is in Germany at the time of conclusion of the contract, the registered office of Digital Language Testing UG in Stadthagen shall be the place of jurisdiction. If your place of residence is unknown or you relocate after conclusion of the contract, this place of jurisdiction shall also apply.
(3) In addition to the ordinary legal process, there is the possibility of out-of-court dispute resolution in accordance with Regulation (EU) No 524/2013 via the online platform of the European Commission: https://ec.europa.eu/consumers/odr/. The General Consumer Arbitration Board of the Centre for Arbitration eV, Straßburger Straße 8, 77694 Kehl am Rhein, is responsible for participation in a dispute settlement procedure. www.verbraucher-schlichter.de.
(4) Should individual provisions of these Terms and Conditions be invalid, the remainder of the contract shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.
